Terms of Service

1. Acceptance of Terms

By creating an account on, accessing, or using TubeCMS (“Service”), operated by TubeCMS (“we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and TubeCMS. By clicking “Sign Up”, completing the registration process, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all users worldwide. Nothing in these Terms affects any mandatory consumer protection rights you may have under the laws of the country in which you reside, where those rights cannot be excluded or limited by contract.

2. Definitions

In these Terms, the following words have the meanings set out below:

  • Service — the TubeCMS platform, including the website at tubecms.app, all subdomains, the admin panel, APIs, and related services.
  • Site — the website created and hosted for you by the Service, accessible at your subdomain (e.g. yourchannel.tubecms.app) or your custom domain.
  • Account — your registered TubeCMS account, identified by your email address.
  • Subscription — a paid Starter or Pro plan with a recurring billing cycle.
  • Free Plan — the free tier of the Service with limited features, available indefinitely at no cost.
  • Your Content — all text, images, files, and other material you upload, create, or publish through the Service. This does not include data fetched from YouTube, Fourthwall, Shopify, or Etsy via their APIs.
  • Maintenance Mode — a state in which Visitors can view a holding page, but the Site’s normal content is not accessible. You retain admin access.
  • Suspended — a state in which your Site displays a suspension notice; admin access is disabled except for limited access to billing and/or data export where stated.
  • Team Member — an additional user you invite to your Account with a designated role (Editor or Viewer). Available on the Pro plan.
  • Visitor — any person who views your Site.
  • Third-Party Services — external services integrated with or relied upon by the Service, including YouTube, Google, Instagram, Meta, TikTok, Fourthwall, Shopify, Etsy, Stripe, Resend, Anthropic, Microsoft Azure, and Cloudflare.

3. Description of Service

TubeCMS is a hosted website platform designed for YouTube creators. The Service allows you to create and manage a website that showcases your YouTube content, including videos, blog posts, and other media. Each Account receives a hosted Site accessible at a subdomain of tubecms.app.

The Service includes:

  • A managed website with automatic YouTube channel integration
  • An administrative dashboard for content and site management
  • Hosting, storage, and delivery of your Site and uploaded media
  • YouTube data synchronisation via the YouTube API
  • Optional Instagram integration via the Instagram API (post syncing and display)
  • Optional TikTok integration via the TikTok API (video syncing and display)
  • AI blog post generation from video transcripts (via Anthropic)
  • Optional merch store integration via Fourthwall, Shopify, and Etsy
  • Additional features depending on your Subscription plan

TubeCMS is designed around your YouTube channel. Connecting a YouTube channel via Google OAuth is a required part of the setup process. Without a connected channel, your Site will be placed in Maintenance Mode and your normal site content will not be accessible to Visitors. If you disconnect your YouTube channel after setup, your Site will return to Maintenance Mode until a channel is reconnected.

Service changes

We may modify, improve, or discontinue features of the Service from time to time. For Free Plan users, changes may be made at any time. For paying subscribers:

  • If a change materially reduces core functionality included in your current plan, we will provide at least 30 days’ advance notice by email.
  • If you are not satisfied with a material change, you may cancel your Subscription before the change takes effect. Annual subscribers who cancel for this reason will receive a pro-rata refund for the unused portion of their billing period.
  • Bug fixes, security patches, and minor interface changes do not constitute material changes and may be made without notice.

4. Account Registration

To use the Service, you must create an Account. When registering, you agree to the following:

  • Age requirement: You must be at least 16 years of age to create an Account. If you are under 18, you represent that you have your parent or guardian’s consent to use the Service.
  • Accurate information: You must provide truthful, accurate, and complete information during registration and keep your Account information up to date.
  • One account per channel: Each YouTube channel may only be connected to one TubeCMS Account. Creating multiple Accounts for the same channel is prohibited.
  • Account security: You are responsible for the security of the email address associated with your Account, as it is used for passwordless sign-in via magic links. You are responsible for all activity that occurs under your Account. You must notify us immediately at legal@tubecms.app if you become aware of any unauthorised use.
  • Channel ownership: You must have the right to connect and use the YouTube channel associated with your Account. You represent that you are the owner of, or are duly authorised to act on behalf of the owner of, the connected YouTube channel.

5. Plans

TubeCMS offers a Free Plan and paid Subscription plans.

Free Plan

Every new Account starts on the Free Plan. The Free Plan includes:

  • A hosted Site at yourchannel.tubecms.app
  • YouTube videos, about page, contact form, FAQ page, merch store (Fourthwall, Shopify, and Etsy integrations)
  • Automatic YouTube synchronisation (new videos appear as soon as you publish; stats refresh every 24 hours)
  • Up to 3 blog posts (1 AI-generated post per month)
  • Basic Analytics (page view counts)
  • Preset themes
  • Image uploads up to 2 MB per file, 10 MB total storage
  • A “Powered by TubeCMS – Websites for YouTubers” badge displayed on your Site

The Free Plan is available indefinitely at no cost. You only pay if you choose to upgrade.

Starter Plan (£2.99/month)

Everything in the Free plan, plus:

  • Blog (up to 50 posts and updates)
  • AI blog posts from your videos (5 per month)
  • Email subscribers — blog posts, new video and live stream alerts (200 subscribers)
  • Link in Bio with click tracking
  • Live stream page
  • 6-hour YouTube sync + manual refresh
  • Custom colours
  • Image uploads up to 2 MB per file, 100 MB total storage

Pro Plan (£6.99/month or £69.99/year)

Everything in the Starter plan, plus:

  • Use your own domain (with free SSL)
  • TubeCMS Analytics (full visitor analytics dashboard)
  • Advanced SEO Toolkit (custom meta, Search Console verification, JSON-LD customisation)
  • Unlimited blog posts and updates (subject to fair use)
  • AI blog posts from your videos (20 per month)
  • Email subscribers — blog posts, new video and live stream alerts (1,000 subscribers)
  • Scheduled post publishing
  • Team Members with role-based access (Editors and Viewers)
  • Discord notifications
  • Image uploads up to 10 MB per file, 1 GB total storage
  • Removal of the “Powered by TubeCMS – Websites for YouTubers” badge
  • Priority support

Complimentary Access

We may, at our sole discretion, grant you complimentary access to a paid plan (Starter or Pro) for a fixed period. Complimentary access includes the same features as the corresponding paid plan and does not require a credit card or payment. When your complimentary period ends:

  • If you have subscribed to a paid plan during the complimentary period, your subscription continues uninterrupted.
  • If you have not subscribed, your Account reverts to the Free Plan. The downgrade effects described in Downgrading from Pro to Starter apply where relevant.

By accepting complimentary access, you agree that we may reference your Site, channel name, and logo in TubeCMS marketing materials (such as our website, social media, and case studies) for the duration of the complimentary period and afterwards unless you ask us to stop.

Complimentary access may be revoked at any time without notice. It is non-transferable and carries no guarantee of renewal.

Fair use

Where a feature is described as “unlimited”, it is subject to fair use. Fair use means normal, human-driven use of the Service consistent with its intended purpose. We consider usage to exceed fair use if it involves automated or scripted bulk operations, or if a single Account consistently uses more than 10× the median usage across all Pro accounts for a sustained period. If we determine that your usage exceeds fair use, we will notify you and work with you to find a reasonable solution before taking any action. We reserve the right to rate-limit or throttle access that exceeds fair use.

Downgrading from Pro to Starter

If you downgrade from Pro to Starter, the following changes take effect at the end of your current Pro billing period:

  • Custom domain: disconnected; your Site reverts to yourchannel.tubecms.app.
  • Analytics: reduced to Basic Analytics (page view counts only). Historical detailed analytics data is retained but not accessible until you upgrade again.
  • Scheduled posts: any posts scheduled for the future will not publish automatically. You can publish them manually.
  • Team Members: all Team Member access is revoked. Only the Account owner retains access.
  • Storage: existing files that exceed the Starter quota (100 MB) remain accessible, but no new uploads are permitted until usage is within limits.
  • Blog posts: if you have more than 50 published posts, all remain published, but you cannot create new posts until you are within the limit.
  • Branding: the “Powered by TubeCMS – Websites for YouTubers” badge is re-enabled.

Your Content is always preserved during a downgrade. No data is deleted.

We reserve the right to change the features included in any plan, introduce new plans, or adjust pricing. Existing subscribers will be given at least 30 days’ notice before any price increase takes effect on their Account.

6. Billing and Payments

All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to the following:

  • Automatic renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date.
  • Payment method: You must provide a valid payment method. You authorise us to charge your payment method for all fees incurred on your Account.
  • Currency and taxes: All prices are quoted in British pounds sterling (GBP). We are not currently VAT-registered in the UK and do not charge VAT. If we become VAT-registered, we may begin charging VAT where applicable and will update our pricing and these Terms accordingly. If you are located outside the UK, you may be responsible for any local taxes, duties, or currency conversion fees applied by your bank or card issuer.
  • Cancellation: You may cancel your Subscription at any time from your Account settings. You retain access to your plan’s features until the end of your current billing period. After that, the timeline set out in Section 11 applies.
  • Cooling-off period: Under the Consumer Contracts Regulations 2013, you have a statutory right to cancel within 14 days of your initial Subscription without giving a reason. If you cancel within this period, we will refund your payment minus a proportionate amount for any service already provided. To exercise this right, contact us at legal@tubecms.app. By subscribing and using the Service immediately, you acknowledge that the service begins during the cooling-off period.
  • Refunds after cooling-off: After the 14-day cooling-off period, payments are non-refundable, except where a material service change entitles annual subscribers to a pro-rata refund (see Section 3). If you believe you are entitled to a refund due to a fault in the Service, contact us at legal@tubecms.app.
  • Failed payments: If a payment fails, we may retry the charge. If payment cannot be collected after reasonable attempts, the timeline set out in Section 11 applies.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation
  • Upload, publish, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Send unsolicited communications, spam, or bulk messages through or in connection with the Service
  • Distribute malware, viruses, or any other harmful or destructive code
  • Attempt to gain unauthorised access to any part of the Service, other Accounts, computer systems, or networks connected to the Service
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein
  • Use the Service to mine cryptocurrency or perform other computationally intensive tasks unrelated to the Service’s purpose
  • Scrape, crawl, or use automated means to access the Service in a manner that exceeds reasonable use or bypasses access controls
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Use the Service to operate a website unrelated to YouTube content creation
  • Resell, sublicense, or provide access to the Service to third parties without our prior written consent

8. Prohibited Content

You must not upload, publish, or otherwise make available through the Service any content that:

  • Promotes hatred or violence: content that promotes, incites, or glorifies hatred, discrimination, or violence against individuals or groups based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic
  • Depicts or promotes violence: gratuitous depictions of violence, gore, or content that encourages real-world harm to people or animals
  • Exploits minors: any content that sexually exploits, abuses, or endangers children, including child sexual abuse material (CSAM). We have a zero-tolerance policy and will report such content to the relevant authorities, including the National Crime Agency (NCA) and the National Centre for Missing & Exploited Children (NCMEC)
  • Infringes copyright or intellectual property: content that violates the copyright, trademark, or other intellectual property rights of any third party
  • Constitutes fraud or phishing: content designed to deceive users, steal personal information, or impersonate legitimate services or individuals
  • Contains illegal material: content that is illegal under the laws of England and Wales, including but not limited to content that promotes terrorism, facilitates drug trafficking, or constitutes fraud
  • Is pornographic or sexually explicit: content that is sexually explicit, pornographic, or intended primarily for sexual arousal
  • Promotes self-harm: content that encourages, glorifies, or instructs self-harm or suicide

Enforcement and appeals

If we become aware of content or activity that may violate these Terms, we will follow this process:

  1. Warning: where appropriate, we will notify you of the issue and ask you to remove or correct the content within a reasonable timeframe.
  2. Content removal: if the content is not removed, or if the violation is serious, we may remove the content ourselves.
  3. Account suspension: for repeated or serious violations, we may Suspend your Account.
  4. Account termination: for the most serious violations (including CSAM, fraud, or repeated infringement), we may terminate your Account immediately and permanently.

We will skip steps where the severity of the violation warrants immediate action (for example, CSAM will result in immediate termination and reporting to authorities).

Appeals: if you believe action was taken against your Account in error, you may appeal by emailing legal@tubecms.app with the subject line “Appeal”. Include your Account email address, a description of the action taken, and an explanation of why you believe it was in error. We will review your appeal and respond within 14 days.

9. Content Ownership

You retain full ownership of Your Content. TubeCMS does not claim any ownership rights over Your Content.

By using the Service, you grant TubeCMS a limited, non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Service. This licence exists only for as long as Your Content remains on the Service and is automatically revoked when you delete Your Content or your Account.

You represent and warrant that:

  • You own or have the necessary rights, licences, and permissions to upload and publish Your Content through the Service
  • Your Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
  • Your Content complies with all applicable laws and these Terms

You are solely responsible for Your Content and the consequences of publishing it through the Service.

10. Copyright Complaints

TubeCMS respects the intellectual property rights of others and expects users to do the same. We handle copyright complaints in accordance with the Copyright, Designs and Patents Act 1988 and applicable international copyright frameworks.

Filing a complaint

If you believe that content hosted on the Service infringes your copyright, you may submit a complaint to legal@tubecms.app. Your complaint should include:

  • Your full name, address, and email address
  • Identification of the copyrighted work you believe has been infringed
  • The URL or location on the Service where the allegedly infringing material can be found
  • A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
  • A statement that the information in your complaint is accurate and that you are the copyright owner or authorised to act on the owner’s behalf
  • Your signature (physical or electronic)

Counter-notice

If you believe your content was removed in error, you may submit a counter-notice to legal@tubecms.app that includes:

  • Your full name, address, and email address
  • Identification of the material that was removed and where it appeared before removal
  • A statement that you have a good-faith belief the material was removed as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the courts of England and Wales for any related proceedings
  • Your signature (physical or electronic)

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 14 business days, we may restore the removed content.

Repeat infringers

We maintain a policy of terminating the Accounts of users who are repeat copyright infringers. If a user receives three valid copyright complaints upheld after review, their Account will be permanently terminated.

11. Data Retention, Export and Deletion

This section is the single source of truth for all timelines relating to data retention, access, and deletion. All other sections of these Terms reference this section rather than stating separate timeframes.

Cancellation (paid Subscription)

Billing period endYour Subscription expires. Your Site enters a 7-day grace period. You may resubscribe to restore full access.
Day 7Your Account is downgraded to the Free Plan. Paid features (blog posts, custom domain, newsletters, etc.) are disabled but your content is preserved. Your Site remains live on the Free Plan.

Failed payment

Payment failureWe retry the charge. Your Site enters a 7-day grace period.
Day 7If payment is still not collected, your Account is downgraded to the Free Plan. You may update your payment method and resubscribe at any time.

Inactive Free accounts

Free Plan accounts that do not have a YouTube channel connected are considered inactive. We apply the following timeline:

Day 30We send you a warning email asking you to connect a YouTube channel within 15 days.
Day 45If no YouTube channel has been connected, your Account and all associated data are permanently deleted. We send a final notification email confirming the deletion.

Connecting a YouTube channel at any point resets this timeline. Paid Subscription accounts (Starter or Pro) are exempt from this policy regardless of YouTube connection status.

Incomplete setup

If you create an Account but do not complete the setup wizard, we apply the following timeline:

Day 7We send you a reminder email encouraging you to complete setup.
Day 14If setup is still not completed, your Account is automatically deleted and we send a final notification email.

Sites not made public

Free Plan accounts that have completed setup but have not made their Site public are subject to the following timeline:

Day 14We send you a reminder email encouraging you to go live.
Day 60We send you a warning email that your Account will be removed in 14 days if your Site is not made public.
Day 74If your Site is still not public, your Account and all associated data are permanently deleted.

Making your Site public at any point resets this timeline. Paid Subscription accounts (Starter or Pro) are exempt from this policy.

Account deletion by you

You may delete your Account at any time from your account settings. Upon deletion:

  • Your Site is taken offline immediately.
  • Your data, including Your Content, site settings, and account information, is permanently deleted within 30 days.
  • If you are on a paid plan, no further charges will be made, but no refund will be issued for the remainder of the current billing period (subject to the cooling-off period in Section 6).

Account termination by us

If we terminate your Account for a Terms violation, your Site is taken offline immediately and your data is permanently deleted within 30 days. We are not obligated to provide a data export in cases of termination for serious violations.

Retention after deletion

Where these Terms state that data is “permanently deleted”, this means Your Content, site configuration, and account profile are removed. We may retain certain records (such as billing invoices, transaction logs, fraud and security logs, and abuse records) where we are required to do so for legal, accounting, fraud prevention, or security purposes.

Data export

You can export Your Content at any time from your admin panel, including during any read-only or Suspended period described above.

12. Third-Party Services

The Service integrates with and relies upon Third-Party Services. By using TubeCMS, you acknowledge and agree to the following:

  • YouTube API Services: The Service uses the YouTube API to synchronise your channel data. Your use of this feature is subject to the YouTube Terms of Service and the Google Privacy Policy. You may revoke TubeCMS’s access to your YouTube data at any time via the Google security settings page. TubeCMS’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
  • Google OAuth: YouTube channel connection is facilitated through Google OAuth 2.0. TubeCMS accesses only the YouTube data scopes necessary to provide the Service. Account sign-in uses passwordless magic links and does not rely on Google OAuth.
  • Instagram API: The Service uses the Instagram API with Instagram Login (provided by Meta Platforms, Inc.) to allow you to connect your Instagram account and display your posts on your Site. Your use of this feature is subject to the Instagram Privacy Policy and Instagram Terms of Use. TubeCMS requests the instagram_business_basic permission (read-only). You may disconnect your Instagram account at any time from your admin panel, or revoke access from your Instagram settings.
  • TikTok: The Service uses the TikTok Login Kit and API (provided by TikTok Pte. Ltd. / ByteDance) to allow you to connect your TikTok account and display your videos on your Site. Your use of this feature is subject to the TikTok Terms of Service and TikTok Privacy Policy. TubeCMS requests user.info.basic, user.info.stats, and video.list permissions (read-only). You may disconnect your TikTok account at any time from your admin panel.
  • Fourthwall: The Service integrates with Fourthwall to display your merch store products on your Site. If you connect your Fourthwall store, product data is fetched live from the Fourthwall API. Your use of Fourthwall is subject to Fourthwall’s Terms of Service. You may disconnect your Fourthwall store at any time from your admin panel.
  • Shopify: The Service integrates with Shopify to display your store’s products on your Site. If you connect your Shopify store via OAuth, we request only the read_products scope (read-only). Product data is fetched live from the Shopify Admin API. Your use of Shopify is subject to the Shopify Terms of Service. You may disconnect your Shopify store at any time from your admin panel.
  • Etsy: The Service integrates with Etsy to display your shop’s listings on your Site. You provide your Etsy shop name and product data is fetched from the Etsy API (read-only). Your use of Etsy is subject to the Etsy Terms of Use. You may remove your Etsy shop at any time from your admin panel. The term “Etsy” is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
  • Stripe: Payment processing is handled by Stripe, Inc. Your payment information is transmitted directly to Stripe and is subject to the Stripe Services Agreement and Stripe Privacy Policy.
  • Resend: Transactional emails (magic link sign-in, welcome emails, contact form notifications) are sent via Resend. Your email address is shared with Resend solely for the purpose of delivering these messages.
  • Microsoft Azure: The Service is hosted on Microsoft Azure. Azure provides the compute, storage, and networking infrastructure that runs the platform. We use Azure Application Insights for server-side performance monitoring and error tracking. Your use of the Service is subject to Microsoft’s Privacy Statement.
  • Cloudflare: The Service uses Cloudflare for content delivery, performance, and security. Visitor traffic may be routed through Cloudflare’s network.
  • Anthropic: When you use the AI blog post feature, the video’s transcript text and title are sent to Anthropic’s API (the Claude AI model) to generate a blog article. This is an optional feature — no data is sent to Anthropic unless you choose to generate an article. The transcript is not stored by TubeCMS after generation; it is fetched, sent to Anthropic, and discarded. Only the resulting article is saved as a draft. Under Anthropic’s API terms, inputs and outputs are not used to train their models. Your use of this feature is subject to the Anthropic Terms of Service.

We are not responsible for the practices, policies, or content of any Third-Party Services. Your use of Third-Party Services is at your own risk and subject to their respective terms and conditions.

13. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of the Service will be accurate or reliable
  • Any defects in the Service will be corrected
  • The Service will be compatible with all devices, browsers, or Third-Party Services

You acknowledge that you use the Service at your sole risk. We recommend that you maintain independent backups of any content you consider important.

14. Limitation of Liability

To the maximum extent permitted by applicable law, TubeCMS, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for all claims arising out of or in connection with these Terms or the Service shall not exceed the total amount you have paid to TubeCMS in the twelve (12) months immediately preceding the event giving rise to the claim. If you are on the Free Plan and have not made any payments, our total liability shall not exceed ten pounds sterling (£10).

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the laws of England and Wales.

15. Indemnification

You agree to indemnify, defend, and hold harmless TubeCMS, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your Content or any material you upload, publish, or make available through the Service
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party rights
  • Any dispute between you and a third party relating to your use of the Service

16. Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will:

  • Update the “Last updated” date at the top of this page
  • Notify you by email or through a notice within the Service at least 14 days before the changes take effect

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your Account.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another jurisdiction, you may also bring proceedings in the courts of the country in which you reside, and you retain the benefit of any mandatory consumer protections provided by the laws of that country.

18. Severability
