  • Keep your license key confidential
  • Use only legitimately obtained license keys

5. Updates and Support

Your license may include access to software updates and support services. The specific terms depend on your license type:

  • Updates are provided at our discretion
  • Support response times vary by license tier
  • We reserve the right to modify update and support policies

6. Your Responsibilities

As a self-hosted solution, you are responsible for:

  • Providing and maintaining suitable server infrastructure
  • Securing your server and TubeCMS installation
  • Backing up your data regularly
  • Ensuring compliance with applicable laws and YouTube's Terms of Service
  • The content you publish through the Software

7. Intellectual Property

The Software, including all code, design, graphics, and documentation, is owned by TubeCMS and protected by intellectual property laws. Your license does not grant you any ownership rights in the Software.

8. Third-Party Services

The Software integrates with third-party services, including:

  • YouTube API: Subject to YouTube's Terms of Service and API Terms
  • Database Systems: Subject to their respective licenses

You are responsible for complying with all applicable third-party terms.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TUBECMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the Software license in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TubeCMS, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Software
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you publish through the Software

12. Termination

We may terminate or suspend your license immediately if you breach these Terms. Upon termination:

  • Your right to use the Software ceases immediately
  • You must destroy all copies of the Software
  • Provisions that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Software after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TubeCMS operates, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any license agreements, constitute the entire agreement between you and TubeCMS regarding the Software.
